Placing and processing orders

Orders are accepted:

• via the website: www.nydala-design.com through the online shop (“basket”), where the Buyer provides contact details, indicates the ordered goods and selects the payment method
• by phone: +48 508 656 353 or +48 508 003 060
• by e-mail at: info@nydala-design.com

When placing an order through the “basket” application, the Buyer receives a confirmation of the order to the e-mail address provided. Orders placed by phone must be confirmed by sending a message to the e-mail address provided. If the order is placed by e-mail, after the Buyer sends the information about the order, the Seller confirms by sending to the e-mail address indicated in the order, the terms of sale together with the total value of the order including VAT. If the Buyer does not collect the ordered products on his own and thus decides to deliver the purchased products by means of transport organized by the Seller, then the quotation sent by the Seller will also include transport costs. In order for the Seller to determine the amount of the fee for transporting the ordered products, the Buyer is required to provide the exact delivery address of the goods. 

Compaints procedure

The seller is obliged to deliver goods free from legal and physical defects. Goods purchased by the Consumer are covered by a two-year warranty from the date of sale.

The furniture is intended for indoor use only at a temperature of 15-30 degrees Celsius. Wooden furniture cannot be used outdoors. Storing them in the sun, in humid rooms or at low temperatures can lead to numerous cracks in the wood, paint surfaces and even distort the furniture. Waxed wooden furniture should only be cleaned with care products. Do not use wet, damp cloth for furniture care. When using the furniture, avoid placing wet or hot objects on it – they may dissolve the protective wax layer and discolor the surface. In this case, the whole piece of furniture should be waxed again.

Due to the limitations of computer monitors, the colors of the furniture shown may be slightly different from the real ones. Wood is a natural material, having its own drawing and unique texture, thanks to which each piece of furniture we make has an individual and unique character. Its natural features cause the possibility of color differences in individual elements of the furniture.

Dimensions listed on the website are external dimensions of the furniture and due to the specifics of the vintage material used there may be differences not exceeding +/- 2%. The Seller reserves the right to make design changes that do not affect the furniture’s operation in order to improve the product.

Complaints should be submitted in writing via e-mail to the following address: info@nydala-design.com. In order to improve the complaint handling process, it is recommended to provide data such as:

• name, surname, address of the awarding entity,
• a description of the subject of the complaint together with attached photos illustrating the reported defects,
• indicate the request.

Complaints are considered within 14 days from the date of receipt. The buyer receives a response in writing. The Seller is liable to the Customer up to the price paid and delivery costs. The Seller shall not be liable for lost profits by the Customer.

Delivery

The seller offers the following methods of receipt and delivery of purchased products:

• courier delivery,
• the Seller’s own transport.
• Personal pick-up from the company’s headquarters

It is recommended that all products that, due to their properties and dimensions, could be damaged during transport by courier and not be picked up by the Buyer in person, should be delivered to the Buyer by the Seller by their own transport, after prior approval of the amount of payment for the Seller’s transport. Upon receipt of the order, the Customer is obliged to carefully check the contents of the shipment. Complaints regarding mechanical damage will be considered only in the case of a damage report, confirmed by the signature of the customer and the supplier of the shipment.

WITHDRAWAL FROM THE CONTRACT

Sales contracts concluded via www.nydala-design.com are distance contracts. Pursuant to the relevant provisions, the Consumer has the right to withdraw from the concluded contract of sale within 14 days from the date of order of the goods without giving a reason. The consumer may withdraw from the contract by submitting a statement of withdrawal via email to info@nydala-design.com

FINAL PROVISIONS

The use of services provided electronically is associated with special risks arising from the interference of third parties. The seller has no influence on the operation and availability of the Internet. Buyers making payments using “electronic payments” should specifically protect information against disclosure to third parties. The Seller reserves the right to amend these regulations for important reasons, ie change of law. In the area not regulated in these regulations, the relevant provisions of Polish law shall apply, in particular: the Civil Code, the Act on the provision of electronic services of July 18, 2002, the Act on Consumer Rights and May 30, 2014.

UNDER NO CIRCUMSTANCES, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE, SHALL WE OR OUR PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR THE INABILITY TO USE ANY SERVICE/PRODUCT OFFERED BY US. COMPANY EXPRESSLY DISCLAIMS ANY LIABILITY TO PURCHASER, ITS CUSTOMERS OR TO END USERS OF ITS PRODUCTS, FOR SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGE TO OR LOSS OF OTHER PROPERTY OR EQUIPMENT, PERSONAL INJURY, LOSS OF PROFITS, BUSINESS OR REVENUES, OR COST OR OTHER DAMAGE, LOSS OR EXPENSE FROM ANY CAUSE WHATSOEVER, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE SALE OR USE OF ITS PRODUCTS.

We will not be responsible for any defect in the Goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, if you use the Goods in a way that we or the manufacturer do not recommend or deem irresponsible, your failure to follow our or the manufacturer’s instructions, or any alteration or repair you carry out without our prior written approval.
